These Terms of Use (“Terms”) are a legal agreement between you and the Association of California Airports (“ACA,” “we,” “us,” or “our”) governing your access to and use of calairports.org, the member area, and related services (the “Site”). Please read them carefully.
1. Acceptance of these Terms
By accessing or using the Site, creating an account, or becoming a member, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site. If you use the Site on behalf of an airport or organization, you represent that you are authorized to bind that entity to these Terms.
3. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Site after changes take effect means you accept the updated Terms.
4. Accounts and registration
Some features are available only to registered members. When you create an account, you agree to provide accurate and complete information and to keep it current. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account.
5. Membership, dues, and payments
- Dues and fees. Membership dues and event fees are described at the time of purchase. By submitting a payment, you authorize the charge for the amount shown.
- Payment processing. Payments are processed by our payment provider, Stripe. Your use of payment features is also subject to Stripe’s terms. ACA does not store full payment card numbers.
- Renewals. Where a membership is set to renew, the applicable renewal terms are shown at signup or in your account. You are responsible for managing renewals and keeping billing details current.
- Refunds. Unless stated otherwise at the time of purchase or required by law, dues and fees are non-refundable. Refund requests are handled according to ACA policy.
- Taxes. You are responsible for any applicable taxes not collected by us.
6. Acceptable use
You agree not to:
- Use the Site in any way that violates applicable law or these Terms.
- Attempt to gain unauthorized access to the Site, other accounts, or our systems.
- Interfere with or disrupt the Site, its security, or its infrastructure.
- Upload or transmit viruses, malware, or harmful code.
- Scrape, harvest, or collect information about other members except as the Site intends.
- Use the Site to send unsolicited communications or to harass, abuse, or harm others.
- Impersonate any person or misrepresent your affiliation with any person or entity.
7. Member content
You are responsible for any content you post, such as directory details, profile information, and forum posts (“Member Content”), and you confirm you have the right to share it. You retain ownership of your Member Content. By posting it, you grant ACA a non-exclusive, royalty-free license to host, display, and use that content for the purpose of operating the Site and the association. You agree not to post content that is unlawful, infringing, defamatory, misleading, or harmful. We may remove content or suspend accounts that violate these Terms or our community standards, at our discretion.
8. Intellectual property
The Site and its content, including text, graphics, logos, and materials (excluding Member Content), are owned by ACA or its licensors and are protected by intellectual property laws. Except for ordinary member and visitor use of the Site, you may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written permission.
9. Third-party services and links
The Site may link to or rely on third-party services, such as payment processing and analytics. We are not responsible for the content, products, or practices of third-party sites and services, which are governed by their own terms and policies.
10. Privacy
Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain how we collect and use information and the choices you have.
11. Disclaimers
The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any information on it is accurate or complete.
12. Limitation of liability
To the fullest extent permitted by law, ACA and its officers, directors, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or related to your use of the Site, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim relating to the Site will not exceed the amount you paid to ACA in the twelve months before the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless ACA and its officers, directors, employees, and volunteers from any claims, damages, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your use of the Site, your Member Content, or your violation of these Terms or applicable law.
14. Termination
We may suspend or terminate your access to the Site or the member area at any time if you violate these Terms or for any other reason at our discretion. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site, and you consent to their jurisdiction and venue.
16. General
These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and ACA regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a transfer of association operations.
